Final appeal to overturn acquittal of Amanda Knox underway in Italy

BY NICK SQUIRES, LONDON DAILY TELEGRAPH FEBRUARY 15, 2012

Italian prosecutors began an appeal Tuesday against the acquittal of American Amanda Knox and her former boyfriend for the murder of British student Meredith Kercher.

Prosecutors in Perugia filed the 111-page appeal to Italy's highest criminal court, the Court of Cassation in Rome, more than four months after Knox had her guilty verdict and 26-year prison sentence overturned.

Raffaele Sollecito, her former boyfriend, also had his guilty verdict and 25-year jail sentence quashed.

Kercher, 21, was found stabbed to death in the house she shared with Knox and two other women in Perugia in 2007. Her body bore more than 40 injuries and lay in a pool of blood on the floor.

Prosecutors claimed that she had been killed during a drug-fuelled, frenzied sex attack by Knox, Sollecito and a third attacker, a local drifter named Rudy Guede. Guede, originally from the Ivory Coast, is serving a 16-year sentence - reduced on appeal from 30 years.

The convictions of Knox and Sollecito were thrown out by an appeals court in October, with the judges and jury deciding that the DNA evidence and witness testimony used to convict them were unreliable.

But Giovanni Galati, a Perugia prosecutor, insisted yesterday that the acquittal contained "omissions and many mistakes" and said he was "convinced" that Knox, 24, and her then-boyfriend carried out the killing. Their acquittal was "contradictory and illogical," he said.

The Court of Cassation is expected to make a ruling on the case toward the end of the year.

If the court's panel of senior judges accept prosecutors' arguments, then a retrial could be ordered. Prosecutors would then request Knox's extradition from the U.S. under a 1984 treaty between the two countries.

It would be up to the discretion of U.S. authorities as to whether they approved the extradition.

The latest appeal is the third and final judicial stage of a saga that has gripped public interest on both sides of the Atlantic for more than four years. Knox continues to enjoy her freedom in her native Seattle and was photographed recently cycling around the city.

Drawing on the diaries she kept behind bars, she is writing a book about her experiences, which is believed to be the subject of a multimillion-dollar bidding war by U.S. publishers.

Alberta worries about becoming racist haven Rough times for Calgary nightclubs and patrons Ruth Davenport June 21, 2001
While the city reverberates with the echoes of the Gay and Lesbian Pride parade, another symbolic step down the path of societal acceptance, trouble brews in Calgary's downtown core at two well-known nightclubs. "I've lived in Calgary for 24 years and I've never come across racism that blatant," said Christina Kang of Calgary. "I've never not been welcome somewhere because I'm Asian." Kang, along with friends Glenda Sanchez, Bosco Fung and three others, were turned away from the Palace nightclub on the evening of May 26. The group, all of Asian descent, were attempting to join a friend's farewell party. Kang, Sanchez and Fung described how bouncers insisted on five specific pieces of identification, including a driver's license, passport, prison ID card, army certificate and a visitor's visa card. "I resent the implication that because I'm coloured I must be an international visitor," said Kang. The three claim that after being denied entry, they expressed a concern to the bouncer of being turned away due to their Asian ethnicity. The bouncer allegedly replied "That's right, spread the word." The three, all Canadian citizens between the ages of 26 and 28, have filed human rights complaints against the Palace through the Alberta Human Rights and Citizenship Commission. Palace night manager Tony Evangelista dismissed the allegations. "Nothing's going to come of it," he said. "Simply put, they're pissed off because they didn't get into the club. We're a private club. We're allowed to deny entrance to anybody."

7 minutes Video: Show video from Global TV 2004, SEGMENT 1 Now, this is the original video which made it on to YouTube, which had an enormous impact on the numbers of people who saw this story. Did any of you see this on YouTube? 15 minutes Reactions from students: What did you see in the video? What do you think is going on? How do you feel about it? What about the issue of clothing? Membership? Age restrictions? Are these legitimate reasons for the nightclubs to discriminate? Actually, Alberta law permits clubs to discriminate on the basis of dress code, age, and membership in some cases. But if a nightclub is considered a ‘service customarily available to the public’ then it cannot have ‘members only’ nights Generally, systemic racism is very difficult to identify and prove. It is extremely rare to find a bouncer saying “You cannot come in because you are brown.” It is far more common to see a racialized group being held to a different standard of dress, or age restrictions, or numbers of pieces of identification requested. When a pattern of discrimination occurs against a specific group, and not just against one individual on one occasion, that we call this systemic discrimination. When that pattern occurs because of security concerns, we call it racial profiling.
"Racism at the door" - journalism at its worst By scorbett in scorbett's Diary Thu Jun 15, 2006 at 01:05:41 PM EST PART 1 - "RACISM AT THE DOOR" The initial idea was to put a hidden camera on a few black or asian guys and watch them try to get into some of the hottest nightclubs downtown. If they get turned away, well, it must be racism, musn't it? They go to the first bar. One of the young black men is denied entrance because his shirt is "too baggy". This sounds like a silly excuse to deny entrance, but perhaps the bartender has a legitimate concern that the young man could be concealing a weapon under his shirt (which was quite baggy). Or, perhaps the bouncer is an unabashed racist - this one is too close to call. They go to the second bar. One of the young asian men is denied entrance because he is wearing running shoes, and the bar has a somewhat more upscale dress code. Racism or routine dress code enforcement? Could be either, or both - again, too close to call. Third bar. This time, two young men are denied entrance because they are under 25, and the bar has an age policy of 25+ in place. Racism?

Media urged to change portrayal of blacks Summit discusses Pittsburgh news coverage of African-American men and boys Wednesday, November 02, 2011 By Michael A. Fuoco, Pittsburgh Post-Gazette
Mainstream media in Pittsburgh must broaden their coverage of black men and youths from a disproportionate diet of crime and sports stories, a summit of scholars, experts and news media executives concluded during a daylong, invitation-only summit Tuesday sponsored by the University of Pittsburgh Public Affairs Office. The Meyer content analysis found that during three months last year, the largest block of news stories involving black men and youth were about crime -- 86 percent of the news broadcasts and 37 percent of the newspaper stories. "And crime coverage featuring black men tended to get more prominent play in the news, with the stories more likely appearing atop the news page or at the beginning of the newscast," the report said. The Pew report found that the most frequent topics for news broadcasts involving African-American men were sports (43 percent) and crime (30 percent). In the newspapers, crime led all topics involving black men at 43 percent. Once crime stories were excluded, the content analysis found there were few other stories about black males. メディア偏向 We rightly get angry about foreign fans racially abusing black players, but are English fans really any better? By Annie Eaves Published 17:22 02/11/1
The next time the English national team are in action and players are subjected to racist chants, don’t feel indignant yet superior. Don’t be consumed by anger and attack the opposing country's fans as being backward. Perhaps they’re just expressing their feelings more honestly than football fans here at home. Maybe it’s wrong to point fingers and accuse fans of some other nations of being racist when the reactions of some here to the issue leave a lot to be desired. Consider this: before last weekend's revelations, if during EURO 2012 an opposition player were to call a black England player a negro, it would surely have been met with almost universal disgust in this country. The FA would have called for strong action and been fully backed by the football supporting public. Seeing a white person in blackface as a part of their Halloween costume is something I’ve come to expect. This year proved to be no different. Starting in college, I’ve seen many variations of a “costume” that included blackface. Of course the wearer of the “costume” always made a bee line for me and attempted to engage me in some type of exchange.

Halloween costume sparks NAACP criticism of Coyotes, Cardinals by Bob McClay/KTAR.com (November 2nd, 2011
The head of the Maricopa County NAACP, Reverand Oscar Tilman, is asking for a meeting with Phoenix Coyotes player Raffi Torres over a Halloween costume. The controversy started when Torres' teammate, Paul Bissonette, tweeted out a picture of Torres and his wife Gianna at a Halloween party. They were dressed as the rap star Jay-Z and singer Beyonce Knowles. The problem is they wore blackface makeup, which Tilman says is offensive to African-Americans. Los Angeles Times columnist Bill Plaschke said in his column that blackface is "a degrading form of makeup used to parody African-Americans." The Coyotes sent KTAR this statement supporting Torres and his wife: "There was absolutely nothing racist about Raffi or his wife's costumes. Raffi is a huge fan of Jay Z and his wife loves Beyonce. It was a Halloween party. The fact that this was reported is ridiculous."

Far-right extremism is much more than a political irritant The committee on the roots of radicalisation needs to challenge the notion that only al-Qaida-inspired extremism must be tackled reddit this Comments (165) Matthew Goodwin guardian.co.uk, Wednesday 2 November 2011
The first concerns the wider social and economic environment. Across Europe, conditions remain ripe for the far right. Large numbers of citizens remain deeply concerned about immigration, feel anxious about the cultural compatibility of Muslims, and are threatened by rising diversity. In fact, in recent years the Brits have become equally if not more concerned about these issues than many of their European neighbours. These voters are also extremely dissatisfied with the response of the main parties to such trendsThe financial crisis has certainly added to this perfect storm, but far-right supporters were pessimistic about their economic prospects long before the collapse of the Lehman Brothers. The key issue is how to respond to voters' profound anxiety about this issue. This not simply affecting older generations. Far from a passing fad, the potential for far-right extremists is reflected in the demographics of their support. Last year in Austria, the Freedom party was the most popular party among those aged under 30, while today almost three-quarters of English Defence League (EDL) members are in the same age bracket. These findings point toward a clear conclusions: the far right is connecting with a new generation. The second concerns the potential for violence. Movements such as the BNP and EDL might not pursue overtly violent goals like AQ-inspired terrorists, but the wider subculture in which they are embedded is characterised by a culture of violence, which cultivates a set of narratives among supporters that would justify its use under certain conditions: it tells them that they and their loved ones are under threat from minority groups; that they will soon be involved in a race war; and that urgent and radical action is required to save them from racial extinction. The line between nonviolent protest and violence has already been crossed by "lone wolves" such as Anders Behring Breivik and, in the UK, affiliates of the Aryan Strike Force (ASF), Racial Volunteer Force (RVF) and the BNP. The third concerns our current understanding of this challenge. As the previous Prevent strategy conceded, our knowledge of the far right is much less developed than our understanding of AQ-inspired terrorism. The good news is that we do now know a lot more about what leads some citizens into the far right. This year alone has seen new research on the BNP, members of the English Defence League and populist extremism across Europe. But the evidence base remains inadequate: we know next to nothing about how those voters compare with far-right violent extremists, or the factors that lead citizens toward one form of activity as opposed to the other.

Nov 2, 2011 1:25pm Forever 21 Criticized for ‘Oriental Girl Necklace’
Forever 21 has the Internet buzzing with an “Oriental Girl Necklace” that some shoppers are calling offensive for its stereotypical depiction of an Asian woman and the use of the outdated term “Oriental.” The charm is of a white-faced girl with her black hair styled in two buns over her ears. It is on sale for $1.50 on the Forever 21 website. There is debate, however, in the online world about whether the item is offensive or racist. Many of those who believe it is offensive comment that the issue is with the word “Oriental,” which is often regarded as a derogatory word when referring to people. “Apparently, Forever 21 thinks that people want to wear outdated, cultural stereotypes as necklaces, and that it’s okay to sell them,” wrote Dhani Mau of style website “Fashionista.” Others think the criticism is an over-reaction and say the charms aren’t offensive. One commenter wrote, “People need to grow thicker skin, get a sense of humor and stop yelling racism at every little thing.”
