クローズアップ２０１２：企業年金２０００億円消失　「老後の備え」どこに

　◇加入団体、広がる不安
　企業年金などの運用を受託している投資顧問会社「ＡＩＪ投資顧問」（東京都中央区、浅川和彦社長）が、高利回りで収益を上げていると虚偽の情報を伝えていたとして、金融庁は２４日、金融商品取引法違反の疑いで同社に１カ月の業務停止命令を出した。同社に預託された約２０００億円の資産の大部分は消失しており、金融庁は、ＡＩＪの運用手法などの解明とあわせ、他の投資顧問会社の運用が適正に行われているかの調査を進める方針だ。【宮崎泰宏、新宮達、堀智行、田所柳子、宮島寛、浜中慎哉】

　業界団体「日本証券投資顧問業協会」の資料によると昨年３月現在、ＡＩＪが受託する投資運用１２３件のうち１２２件は企業年金。「老後の備えに」と貴重な資金を託していた団体からは不安の声が上がっている。

　京都府建設業厚生年金基金は、０７年と０９年に計１５億円の投資運用委託をした。同年金基金の時価資産総額の１割強に上るという。担当者は「これまでの運用は非常に順調。今年１月には（１５億円が）１９億円になったと報告を受けていた。それが突然、こんなことになって」と驚きを隠せない。ＡＩＪからは２４日になり、「金融庁の調査が完了しないと何も対応できない」というファクスが届いただけだといい、「基金の加入員からも問い合わせがあって不安そうだった。情報収集したい」と話した。

　年金基金は通常、複数の運用機関に分散投資している。富山県病院厚生年金基金も、資産のごく一部に関しＡＩＪに投資運用を委託していたという。「北陸の別の年金基金からの紹介で今年度から取引を始めた」という。関西のある投資顧問会社は「ＡＩＪは、中小企業団体の年金基金に狙いを定めて営業していたようだ。ある県の団体を顧客にできれば、実績を強調して他県の年金基金にも営業できる。営業を拡大するための戦略にしていたのではないか」と推測する。

　全国に５９５ある厚生年金基金（１０年度）の７割強で、将来の給付に備えた積立金が不足するなど、企業の年金財政は厳しい。ＡＩＪに資金を運用委託していた年金基金の今後について、企業年金連合会は「基金ごとに対応は分かれるが、内部の資産を売却して穴埋めできなければ、年金受給額を減らしたり場合によっては解散に追い込まれる基金もあるのでは」と懸念している。

　◇規制緩和で参入急増
　日本の年金制度は、（１）国民全員が対象の基礎年金（１階）（２）会社員などが加入する厚生年金や共済年金（２階）（３）企業が独自に上乗せする企業年金など（３階）－－の３階建てになっている。２階までは公的年金として、政府が保険料を集めて「年金積立金管理運用独立行政法人」が民間に運用を委託。運用資産約１０９兆円のうち６７％は国債など安全な代わりに利回りは低い金融商品で運用している。

　３階部分の企業年金は、従業員や企業の資金を元手に、機関投資家に運用を委託するなどしている。公的年金を補う目的で、大手企業などが独自に整備した。かつては信託銀行や生命保険に運用は限定されたが、９０年以降の金融自由化と９７年の規制緩和で参入事業者が急増した。企業年金連合会によると、企業年金の資産残高は約７３兆円（１１年３月末）で、投資顧問会社が約３割、信託銀行が約５割、生保が約２割を運用している。

　投資顧問会社の運用の特徴は「生保などに比べてリスクを取ること」（金融関係者）とされる。リーマン・ショック後の株価低迷で国内株式を減らす一方、安全な国債に加えもうけも大きいが損失を被る可能性も高いヘッジファンドへの投資を増やす動きもあるという。

　ただ、金融市場の低迷で運用環境は悪化している。連合会のまとめでは、企業年金の運用利回りは９０年代までプラスだったが、００年度にマイナスに転落。その後０５年度にプラス１９・１６％を記録するなど乱高下している。１０年度は資産の約２７％を国内債券、約５％をヘッジファンドで運用し、利回りはマイナス０・５４％だった。

　それでも、「２０００億円規模の資産を消失させるのは異常」（大手生保）。大手証券アナリストは「海外の信託銀行などを取引に使ったり、複雑なデリバティブ（金融派生商品）などを組み合わせて損失が見つからないようにしていたのでは」と指摘する。

　◇「高収益」のＡＩＪ　監視委、定期検査せず
　今回の問題が発覚したきっかけは、ＡＩＪの「高収益」に疑問を感じた外部からの指摘だった。一方で、ＡＩＪは８９年の設立以来、証券取引等監視委員会の定期検査を受けたことはなかったという。当局の監督体制のあり方も問われそうだ。

　ＡＩＪは詳細な運用実績などの公表資料が少なく、「秘密主義で、運用手法が分からない」（証券アナリスト）との指摘があった。金融庁と監視委は、投資顧問会社に事業報告書の提出を義務づけ、財務の定期検査もしているが、顧客から年金運用を一任されている「投資一任業者」は２６３社に上る。検査は年１５社程度しかできず、単純計算で約１７年に１回しかない。事業報告書では「虚偽報告を見抜くのは困難」（金融庁関係者）という。

　投資顧問会社は、０７年に認可制から登録制になったこともあり急増。契約資産は１４６兆円（日本証券投資顧問業協会、１１年９月末）に及ぶ。金融庁は運用資産の大半が消失するという異常事態に、違反行為が確定しない段階でＡＩＪの全業務を停止させる厳しい措置を取り、投資一任業者すべてを調査することを決めた。週明けに調査項目を事業者に通知する。

　自見庄三郎金融担当相は２４日の記者会見で「（規制強化などの）選択肢を排除しない」と説明。他にも悪質な例があれば、検査・監督体制の強化や制度改正を検討する。金融庁には「認可制に戻すなど幅広く検討すべきだ」（幹部）との声もある。

ＡＩＪ投資顧問　なぜ野放しにされたのか

　金融庁は、企業の年金資金を預かって運用していたａｉｊ投資顧問5 件（東京、浅川和彦社長）に対し、金融商品取引法に基づく１カ月の業務停止命令を出した。

　証券取引等監視委員会の検査で、ＡＩＪが企業から運用を任せられた約２１００億円の年金資金について、その大半が消失していることが分かったためだ。

　金融庁と監視委は、ＡＩＪの業務を停止させて実態解明を進めることにした。

　金融関係者によると、ＡＩＪに資金の運用を委託していたのは地方の建設、トラック関係の企業年金が多いという。

　不祥事が起きるたびに言われる。なぜこんなことになったのか。どうして防げなかったのか。こんなことが起きるかもしれないと誰も考えなかったのか、と。

　そして、答えはいつも同じになる。決して予想できないことではなかった。

　ちょっと背景を整理してみたい。

　まずは企業年金の運営の難しさだ。

　次は金融商品取引法ができた理由だ。

　企業年金の代表格と言えば厚生年金基金だった。企業の従業員の公的年金は基礎年金の上に厚生年金が乗る２階建てになっている。この厚生年金分の一部を国に代行して支給したり、独自の上乗せをしたりするのが厚生年金基金である。

　金利が高ければ、国に支払う保険料の一部でも自分たちで運用した方が得になる。だが、いまのような超低金利では、運用益をひねり出すのは容易ではない。

　だから、厚生労働省も２００１年に制度を改革し、代行部分を国に返上できる仕組みをつくった。これで厚生年金基金は急減したが、資金難などもあり、新たな制度に移行できないところもある。

　運用に苦しむこうした企業年金に、高利回りをうたい文句に誘いをかける運用業者が出てくることは当然予想できる。

　一方、証券取引法を改めて０６年に金融商品取引法が国会で成立した。この法律の眼目は「貯蓄から投資」である。

　預貯金に偏った日本の金融のあり方を変え、株式投資などに誘導していく。このため、行政は公正で透明性のあるルールをあらかじめ示し、そのルールが守られているか事後的にチェックする。

　しかし、法律で定められた厚労省による企業年金の監督も、金融庁や監視委による資金運用業者に対する監督、検査も形式的だったと言わざるを得まい。

　大事な資金を簡単に預けた企業年金も問題なしと言えない。欲を出した。ただＡＩＪの資料では、５人いるファンドマネジャーの平均経験年数は２１年８カ月とベテランぞろいだった。運用報告でも確実に利益を上げていた。それがウソと断じるのは難しいし、解約も難しかろう。

　監視委によるＡＩＪの検査は今回が初めてだったという。その間、ＡＩＪが行った粉飾には誰も気を留めなかった。

　金融庁は、ＡＩＪと同様に投資一任を受ける業者２６３社の一斉調査を実施する。問題が広がらなければいいが。金融行政が甘かったと言わざるを得ない。

The ruling, made last November but released on Thursday, stems from a case brought in the eastern German state of Thuringia, where an 82-year-old man walked into a pub and began complaining about a documentary on World War II that was running on a TV there.

He questioned what he called the “lies” about the origins of the war, and the role that Jews supposedly played in altering the historical record afterwards.

He then returned two days later, began another argument and gave the landlord several neo-Nazi pamphlets. One of these, entitled “The historical lie of the so-called attack on Poland in 1939,” claimed that no gas chambers were used in the Third Reich.

The landlord kept the fascist pamphlets and later pressed charges against the man, who was convicted of hate crime through distributing literature in two Thuringia courts in June 2006 and April 2007. The man – who believed his freedom of speech had been violated – then appealed to the constitutional court, who ruled in his favour.

Germany’s highest court, based in the western town of Karlsruhe, said that the man’s arguments counted as freedom of speech, and were thus protected by article five of the German constitution. The ruling also said the man, who one judge described as “even today a zealous proponent of National Socialist ideology and historical forgery,” had not committed hate crimes, because he had only passed on the literature to one other person.

“Even the dissemination of National Socialist ideas as a radical questioning of the status quo” is not necessarily outside the protection of article five, the court said.

Holocaust denial remains illegal in Germany, the court underlined, saying the Holocaust was “a historically-proven fact that normally does not come under the protection of the freedom of speech.”

But the court decided that this was not the decisive point of the man’s arguments. He was simply using the denial as an “introductory attempt at an explanation” to deny Germany’s guilt for World War II in general.

Some critics do see Germany’s law on Holocaust denial as a threat to the freedom of speech, but the court expressly said that this ruling in no way affected that law.

河村市長「裏ではなく堂々と言おうと思った」
　

名古屋市の河村たかし市長の南京事件（１９３７年）を否定する発言に反発し、友好都市提携を結ぶ中国・南京市が当面の交流停止を表明したことについて、河村市長は２２日、発言の撤回や謝罪はしないとしたうえで、「友好関係は不変で、これまで３４年間に重ねてきた交流を今後も続けたい」とのコメント文を読み上げた。

　発言について、河村市長は市役所内で記者団の取材に応じ、「国会議員時代から何度も言ってきたこと。総領事にも伝えてある」と説明。南京市側の反応については「現地で公開討論会をやりたい。私も行くので、すべて聞いてもらえば、私の気持ちも分かるはず。話し合うのもいかんというのは、いくらなんでもどうかと思う」と述べた。

　また、河村市長は２２日夕に東京・内幸町の日本記者クラブで行われた記者会見でも、「戦闘行為の中で多くの方が亡くなったが、一般人で何十万という大虐殺はなかったのではないか。目撃者もいない」と、重ねて持論を展開した。

　南京市の訪問団を前に発言したことについても、「真の友好のためにも事実を明らかにする必要がある。中国共産党の方が来たので、裏ではなく堂々と言おうと思った。もし私が間違っていれば、議論の場で言ってもらいたい」と語った。

　名古屋市には２０日以降、約３３０件の意見が電話やメールで寄せられた。このうち約２７０件が「よく言ってくれた」と、市長の発言を支持する内容で、約６０件が「無責任な発言」とする抗議だったという。

３０代妻へそくり、夫の２．７倍　オリックス銀調査

３０代の妻のへそくりは平均１２４万円で、夫の約２．７倍――。オリックス銀行が昨年１２月、全国の２０歳以上の既婚者約２１００人に行ったネットアンケートでそんな結果が出た。

　「へそくりがある」と答えたのは夫６４．３％、妻６９．０％。平均額は夫１１２万円、妻１７１万円で、２０代を除くすべての世代で妻のへそくり額が夫を上回った。妻は年代が上がるとへそくり額も増えるが、夫は３０代で大きく減る。同行は「子育てなどで３０代は家計の余裕が少なく、夫の小遣いにしわ寄せがいくためではないか」と話す。

　地域別では、近畿圏でへそくりの夫婦間格差が７７万円（夫約９３万円、妻約１７１万円）と最大。同行は「お小遣い制の夫の割合が近畿圏で高いためではないか」とみている。

甲状腺被曝、最高３５ミリシーベルト　いわきの子ども

東京電力福島第一原発事故の影響による子どもの甲状腺の被曝（ひばく）問題について、内閣府の原子力安全委員会は２１日、昨年３月下旬に福島県いわき市で実施した検査で、甲状腺の局所の被曝線量が最高で３５ミリシーベルトだったという評価値を公表した。

　現地対策本部は昨年３月下旬、安全委の助言に従って、福島県内で子ども１０８０人に対する甲状腺検査を実施した。安全委の公表資料では、いわき市の１３７人（０～１４歳）のうち、１１人の線量は５～３５ミリシーベルトと高かった。２番目は２５ミリ、次が２１ミリシーベルトだった。政府は当時の検査は精度が低いとし公表していなかった。

　ただし、国際原子力機関（ＩＡＥＡ）の甲状腺被曝を防ぐために安定ヨウ素剤を飲む基準は１歳児で５０ミリシーベルトで、これを上回る結果はなかった。

　２０日に公表された福島県民健康管理調査では、全身に体の外から浴びた被曝線量の評価値は、一般県民の最高で２３ミリシーベルトだった。今回は甲状腺の局所的な被曝線量を評価したもので、国際放射線防護委員会（ＩＣＲＰ）の計算式では全身の外部被曝線量に換算するときには、２５分の１になる。

青森の雪に「被爆の恐れ」…沖縄でイベント中止

　

那覇市は２１日、海上自衛隊第５航空群（那覇市）が青森県から持ち帰った雪を使い、市内で２３日に予定していた子ども向け雪遊びイベントの中止を決めた。


　東日本大震災で市内に避難している人から「放射性物質が含まれ、被曝

する可能性がある」との声が相次いだためという。

　市などによると、雪は同県十和田市で集められた約６３０キロ。海自八戸航空基地（青森県）での寒冷地訓練に参加した隊員が１６日、段ボール２５個に詰めて哨戒機で運んだ。隊員が同機への搬入と搬出の際に放射線量を測定したが、いずれも問題ない値だった。

　那覇市は２０日、市内の集会場で避難者に安全性を説明したが、「政府や自治体の説明は信用できない」といった意見が出て理解は得られなかった。イベントは今回が１８回目の予定だった。

「台湾の誇り」に差別的表現、人権団体が非難　ＮＢＡの新星

　１９日に戦時中の日系人に対する強制収容７０年を迎えた米国社会では、アジア系移民に対する差別がいまだ残っている。陸軍では、ニューヨーク市チャイナタウン出身の２等兵が昨年１０月に派遣先のアフガニスタンで、同僚の兵士から人種差別的ないじめを受けたのを苦に自殺した。同僚兵士らはすでに起訴されたが、海兵隊でも昨年４月に中国系の兵士がいじめを理由に自殺している。

　米司法省と教育省が１０代の学生を調査した統計（２００９年実施）によると、３１％の白人、３４％のヒスパニック、３８％のアフリカ系が「学校でいじめを受けたことがある」と答えたのに対して、アジア系学生の場合は５４％に達するという。

WASHINGTON - Asian Americans endure far more bullying at US schools than members of other ethnic groups, with teenagers of the community three times as likely to face taunts on the Internet, new data shows.

Policymakers see a range of reasons for the harassment, including language barriers faced by some Asian American students and a spike in racial abuse following the September 11, 2001 attacks against children perceived as Muslim.

"This data is absolutely unacceptable and it must change. Our children have to be able to go to school free of fear," US Education Secretary Arne Duncan said Friday during a forum at the Center for American Progress think-tank.

The research, to be released on Saturday, found that 54 percent of Asian American teenagers said they were bullied in the classroom, sharply above the 31.3 percent of whites who reported being picked on.

The figure was 38.4 percent for African Americans and 34.3 percent for Hispanics, a government researcher involved in the data analysis told AFP. He requested anonymity because the data has not been made public.

The disparity was even more striking for cyber-bullying.

Some 62 percent of Asian Americans reported online harassment once or twice a month, compared with 18.1 percent of whites. The researcher said more study was needed on why the problem is so severe among Asian Americans.

The data comes from a 2009 survey supported by the US Justice Department and Education Department which interviewed some 6,500 students from ages 12 to 18. Asian Americans are generally defined as tracing ancestry to East Asia, the Indian subcontinent or the South Pacific.

The research, to be released on Saturday, found that 54 percent of Asian American teenagers said they were bullied in the classroom, sharply above the 31.3 percent of whites who reported being picked on.




ESPN wrong to apologize for ‘chink in the armor’

Jeremy Lin, who was born in the U.S. and is of Taiwanese heritage, is off to one of the best starts in NBA history. But much of the talk surrounding the New York Knicks breakout point guard has revolved around race.
After his first loss as a starter, ESPN analysts wondered aloud if Lin had any weakness using the worst possible phrasing: asking if there was "a chink in the armor." Since then, the network has fired the person responsible for publishing the headline on ESPN.com and suspended a broadcaster for 30 days, as well.
Despite the controversial nature of using this phrase to describe this player, the most socially damaging things ESPN could have done were issue a public apology and reprimand its employees.
Imagine a young Knicks fan who loves Lin and sees ESPN apologize for using "chink in the armor." He then asks: "Dad, what does chink in the armor mean?"
Dad answers saying that it's a phrase used for when someone has only one weakness. Then the young fan asks why it's bad to say, and dad is forced to explain to him the derogatory use of the word "chink." Thus, a meaningless racial slur is preserved because of the hyper-sensitive political correctness of modern media.

This past weekend, two ESPN employees who managed to use the phrase “chink in the armor” to describe Jeremy Lin were swiftly punished for the offenses.

The question on everyone’s mind now is: did the punishments fit the crimes?

Anthony Federico, 28, made the far more stupid gaffe of the two on Saturday night when he posted the following headline on ESPN’s mobile website: "Chink in the Armor: Jeremy Lin's 9 Turnovers Cost Knicks in Streak-Snapping Loss to Hornets." The headline was posted at 2:30 in the morning, and then removed slightly more than a half an hour later when someone (finally) realized that it may be construed as an offensive remark.

By Sunday afternoon, Federico was no longer an employee of ESPN.

The World Wide Leader’s other major Lin-related gaffe came a few days earlier, when Max Bretos, a well known ESPN television personality, posed the following question live on the air:

"If there is a chink in the armor, where can he improve his game?" he asked.



As punishment for his mistake, Bretos was handed a 30-day suspension.

Over the weekend, he tweeted this apology:

Wanted 2 apologize 2 all those I have upset. Not done with any racial reference. Despite intention,phrase was inappropriate in this context.

My wife is Asian, would never intentionally say anything to disrespect her and that community.

All things considered, it’s clear why Bretos’ punishment wound up being much lighter than Federico’s. Whereas the latter had ample time to work up a good headline, think about it, review the phrase and then run it past someone prior to posting it on the website – Bretos was working on live TV. Working on live TV means you have less time to think about your phrases, their double meanings and the potential consequences of what you say.

There is even a case to be made that Bretos’ punishment was too harsh given the seemingly innocent nature of his crime.





東京・渋谷のサメ死骸：撮影、翌日回収のはずが…放置の男性「反省」

　東京都渋谷区の代々木公園で見つかったサメの死骸を現場に置いたのは港区の自称会社員の男性（２５）だったことが警視庁代々木署への取材で分かった。男性は写真撮影が趣味で、公園近くの回転すし店で譲ってもらったサメを１８日に公園で撮影し、翌日回収するつもりだったという。「故意性は低い」として立件は見送られる見通し。

　代々木署によると、男性は１５日、すし店前に展示してあった体長約１・５メートルのサメを「撮影したい」と譲ってもらい、一度都内の友人宅に運んだ。１８日夜に友人らと代々木公園に運び、駐輪場近くで撮影したが、約１００キロと重いため１人では動かせず、取りあえずサメをブルーシートで覆って帰宅したという。

　男性は１９日夕方に知人と一緒に公園からサメを運び出すつもりだったが、その間に騒動になった。男性は「こんな騒ぎになって驚いている」と反省しているという。

　代々木署に保管されていたサメは２１日、男性の依頼を受けた業者に処分された。【伊澤拓也】

　東京都渋谷区の代々木公園で１９日朝にサメの死骸が見つかった問題で、サメを置いたのは、東京都内在住の男性会社員（２５）であることが２１日、警視庁代々木署などへの取材で分かった。
　男性は１５日、東京都渋谷区道玄坂の人気回転すし店「すし台所家渋谷本店」が店頭展示していた「モウカ（毛鹿）ザメ」を「芸術に役立てたい」と無償で受け取った後、近くの友人宅で保管。１８日午後９時ごろ、代々木公園の「渋谷門」内駐輪場にサメを運び出し、写真撮影をした。
　しかし、男性はサメが体長約１メートル５０、重さ１０２キロと大型の上、夢中で撮影しているうちに夜中になってしまったため、１９日夕に友人らと取りに戻るつもりで、ひとまずブルーシートに包んで置いて帰ったなどと同署に説明。「大変な騒ぎになっているのでビックリした」と驚きの表情を見せていたという。
　代々木署では、廃棄物処理業者を男性自らが手配し、２１日にサメを処分したことなどから、不法投棄の意思はなかったと判断。処分しない方針という。
　「すし台所家渋谷本店」はこれまで、サンケイスポーツの取材に「サメは煮物、焼き物、揚げ物で提供する予定だった」などと話していた。

東京・代々木公園で19日朝（2012年2月）にサメの死骸が見つかった騒動では、それとよく似たサメが公園から約1キロ離れたすし店の前に15日までいたことがわかったそうだ。このすし店は14日、サメを食用に購入したが、大きすぎて調理場に入らないため、店頭に置いて展示していたという。
「芸術的な観点で使いたい」と外国人
それが15日夜になって、芸術家を名乗る外国人が現れ、「芸術的な観点で使用したい」（すし店社長談）と申し出たために、譲り渡したという。

「どうしたんでしょうね。芸術家の人が手に余っちゃったってことですかね」と羽鳥慎一キャスターが首を傾げる。スタジオのコメンテイターからは、公園にサメを置いたこと、その置き方がひょっとしてアートだったのではないかといった見方も出たが、進行の小松靖アナは「青いビニールシートにくるまれて置かれていたので、それを芸術と呼べるのかどうか」と懐疑的だった。




堺ロープ傷害事件　少年７人全員を保護観察処分2012年2月22日20時1分

　堺市内の路上で昨年７月、信号待ちの男性に自転車からロープをひっかけてけがをさせたとして、少年７人が傷害の非行内容で送致された事件で、大阪家裁堺支部の真鍋麻子裁判官は２２日の少年審判で２人を保護観察処分とする決定を出した。昨年９月に決定を出した５人とあわせ全員を同処分とした。

　大阪地検堺支部などによると、少年７人は堺市内の１８～１９歳。昨年７月１５日早朝、堺区の路上で５０代男性に自転車で背後から近づき、ゴム製のひもの両端を引っ張り、男性に巻き付け引き倒そうとして軽傷を負わせた。うち２人は直前にも７０代男性の首にひもをひっかけけがをさせたとして、追送致されていた。

【ワシントン】日本の昨年の原子力発電所事故の数日後、米国は原発から50マイル（80キロメートル）圏内という、日本の設定を大きく上回る範囲からの米国人の避難を命じて、世界を驚かせた。これが同盟国の日本に恐怖と混乱の種をまいた。

　原発事故からほぼ1年たった現在、米国当局者のやりとりの模様の記録が公表され、どのようにして、使用済み燃料棒がむき出しになっているかどうかに関する少なくとも部分的に不完全な情報に基づいてこうした措置が取られたのかを、これまでになく明確に示した。

　ウォール・ストリート・ジャーナルとその他の組織が情報公開法に基づいて請求したこの文書は、米原子力規制委員会（ＮＲＣ）オペレーションセンター（メリーランド州ロックビル）からの、福島第1原発事故発生後10日間の関係者のやりとりを記録している。

　それによると、米国の原子力当局者は7000マイル以上離れた所で起きた危機の重大さを把握するのに苦闘し、日本側からの情報の欠如に不満を漏らし、一部のケースでは放射能リスクを評価するために独自の情報を使おうとした。

　ＮＲＣは日本が認める数カ月前に、福島第1原発は3重のメルトダウンに見舞われる可能性があることを正しく予測していた。

　しかし、避難範囲に関するやりとり―おそらくは差し迫った危機への対応におけるＮＲＣの最も重要な役割―は、ヤツコ委員長が事故発生第1週に「戦場の霧」と呼んだところのものを示している。

　ＮＲＣ当局者は当初から状況を重大に受け止め、3月12日には50マイル圏内からの避難が必要かどうか、また折に触れて、日本全体からの「全般的避難」が正当であるかどうかについても話し合った。

　ＮＲＣのボーチャード運営部長は同16日、ヤツコ委員長に対して、「これが米国での事故なら、50マイル圏内から避難する」と述べた。同委員長は、米当局者が使用済み核燃料棒を貯蔵している4号機のプールには水がなくなっていると信じていたことから、このアドバイスを受け入れた。燃料棒から放射性物質が出ないようにするには水が必要なことから、このままでは大量の放射性物質が大気中に排出される公算が大きいことになる。

　4号機は同15日に爆発した。日本にいたＮＲＣのジョン・モニンガー氏は「この爆発でプールの壁や構造物は破壊され、水は燃料棒の底部にまで下がった。よってプールには水がなくなった」とＮＲＣのスタッフに伝え、これがヤツコ氏に伝達された。

　ヤツコ氏はこれを受けて16日、日本の避難範囲をはるかに上回る規模での避難を勧告すると米議会に通告した。この時日本では、12マイル圏内からの避難と18マイル圏内での屋内退避が呼び掛けられていた。

　この相反する避難範囲が日本で恐怖を引き起こした。これはヤツコ氏の議会証言よりも前に日本の当局者はプールには水があるとの結論に至っていたからだ。

　モニンガー氏は続いてＮＲＣスタッフに対して、日本の当局者は「これらの壁が破壊されれば、放射能レベルは急激に高まると信じている」と伝えた。ヤツコ氏は自分の「信頼性」を心配して、議会証言の内容を撤回すべきかどうかＮＲＣスタッフに尋ねた。

　同氏は日本におけるＮＲＣ代表団のトップ、チャック・カスト氏に、「では現在ではプールに水がないとは考えていないのか。私が聞いていることはそういうことなのか」と尋ねた。これに対してカスト氏は「昨日5時の時点ではプールにいくらかの水があったということになるだろう」と答えた。

　しかし、その直後にカスト氏は、プールには水がないと自分が納得したいくつかの新しい情報を報告。他のＮＲＣスタッフに対して、「私はプールには水がないと一段と確信している。建物に大きな被害が出ている。職を賭してもいい」と述べた。これはヤツコ氏に伝達され、同氏は証言内容の撤回は不要と判断した。

　記録文書ではこの情報源は明記されていないが、米国は当時原発上空に無人偵察機を飛ばしていたことを明らかにしている。

　日本は数カ月後、写真やその他の分析からプールは「ほとんど無傷」だったとの判断を下した。東京電力は12月の報告で、使用済み燃料が水に満たされていたと述べている。

　ヤツコ氏は最近、この点を認めながらも、広範な避難を命じたのには他の理由もあると指摘した。日本はその後、原発から25マイル以上離れた一部地域も含めて避難範囲を拡大した。

　福島原発とは関係はないが、同氏のＮＲＣでの評価はしばしば極端に分かれる。ＮＲＣの4人の委員は、同氏の怒りやすく専横的なスタイルは安全を追求するＮＲＣの使命を脅かすと話している。これに対して同氏は、自分の管理スタイルには何ら問題はないと述べた。

「正しいと思う」石原知事、河村市長発言を擁護

東京都の石原慎太郎知事は２４日の定例記者会見で、旧日本軍が多数の中国人を殺害した「南京事件」を巡って名古屋市の河村たかし市長が「虐殺はなかった」と発言したことについて、「河村君の言うことが正しいと思う」と語り、同市長を擁護した。


　石原知事は「あれだけの期間に４０万人なんて物理的に殺せるわけがない」と持論を展開。市民感情が大きく傷つけられたなどとする中国側の主張に対し、「戦争のどさくさで、殺したこともあったかもしれないが、それをもって『大虐殺』というのは違う」などと語った。

I’m lenawash, the guy he sent that very nice tweet to. I was an amused bystander of all this mess but the shit started to cool down and I was bored at work so I thought I would go check his feed. I found the following tweet :

I cannot provide a link, apparently I’m not allowed to see that status… wonder how he does that.
Anyway being french and knowing that more than 70% of french power comes from nuclear, I thought it must be one the most stupid thing to do for anybody AND an insult to all people seeking refuge status all over the world… So I directly asked that Mr. Mochizuki to confirm that claim. My question and the answer from Mochizuki-san. As you can see if you speak japanese, the guy perfectly realizes it’s an idiotic claim and denied everything. When I pointed that fact to our dear Christopher Johnson freelance reporter of Thailand and Asia and Japan, he said that he got “sources” claiming that Mochizuki told a reporter that he was living in Bruxelles (which is not in France) and seeking asylum in France and asked Mochizuki to confirm this. To which Mochizuki quite succinctly replied : “No, I didn’t.”
So I pointed out to Christopher Johnson freelance reporter of Thailand and Asia and Japan that he got it wrong again and maybe it was because he doesn’t speak french which is a difficult language. As you can see, I was not (to that point) being insulting or anything. And this is what I got…
Anyway I was partly wrong, he can speak some decent french. As you may know, “mange ma merde, 阿房なidiote.” means “eat my shit, stupid idiote”. And by the way, I must point that “idiote” is written in the feminin form which means either he has poor control of the french language or he thought I was a woman. Maybe I should put my penis as a twitter profile picture. That would look so deliciously french…

大量の不満分子を生んでいる、というわけではない。ですから最近は、日本がかなりよくみえます。




クルーグマン　国家債務についてヒステリカルになりすぎない、ということです。二〇〇二年にS＆Pが日本国債を格下げしましたが、結局のところ、何も起こりませんでした。これほどの借金があり、問題が解決しているわけでもありませんが、現時点で日本は悪いモデルではないのです。ヨーロッパで起きていることに比べれば、日本は非常に幸せな国であるとすら思えます。




－　最後に日本の読者、そしてファンへのメッセージをお願いします。

クルーグマン　いいたいのは、あまり心配するな、ということです。日本の状況はこの二十年、ほとんど変化していません。現状と共生しているのです。国債が暴落するとか、超円高になるかもしれないとか、そういう心配をする必要はない。しかし、日本はこの状況に慣れていますが、他の国はそうではない。だから私は恐れているのです。

ＮＰＴ＝核拡散防止条約が発効する前年の１９６９年、原子力施設への査察を非核保有国に限るとしたＩＡＥＡ＝国際原子力機関の方針に対し、日本政府が「平等性を確保しえない」として異議を唱える一方、核保有国のアメリカが日本の主張を批判していた実態が、公開された外交文書で明らかになりました。
これは公開された外交文書のうち、ＮＰＴ発効の前年の１９６９年７月に、当時の愛知外務大臣がスウェーデンとスイスの日本大使館に送った文書から明らかになりました。
それによりますと、日本政府は、原子力施設への査察を非核保有国に限るとしたＩＡＥＡの方針について、「アメリカやイギリスなどとの実質的平等性を確保しえない」として異議を唱え、ＩＡＥＡの事務局長に日本の主張を説明する文書を送っていました。
一方、同じ年の５月に愛知大臣がオーストリア駐在の大使に送った文書からは、アメリカが日本の主張について「ＮＰＴの発効を遅らせることになる。害があり、当惑せざるをえない」と批判していたことが明らかになり、核保有国をいわば「特別扱い」するかどうかを巡って、日米が対立していた実態が浮き彫りになりました。
ＮＰＴは、結果的に日本が譲歩する形で翌１９７０年に発効しましたが、別の文書からは、日本の電力業界が「査察の受け入れによって、発電コストが増す」などとして経済的な負担を懸念していた実態も明らかになっており、当時の日本政府の主張の背景には、こうした経済界の意向もあったことがうかがえます。

発砲の２警官に懲役６年求刑　奈良地裁付審判
　

奈良県大和郡山市で２００３年、逃走車の助手席の男性が警官の発砲を受けて死亡した事件の付審判（ふしんぱん）で、殺人と特別公務員暴行陵虐致死の罪に問われた萩原基文（もとふみ）被告（３５）＝現・捜査１課＝と東（ひがし）芳弘被告（３５）＝現・組織犯罪対策２課＝に対する裁判員裁判の論告求刑公判が２０日、奈良地裁であった。

　検察官役の指定弁護士は「警官に許された行為を超えた違法な発砲で、殺意もあった」と述べ、２人に懲役６年を求刑した。弁護側は求刑後の最終弁論で「危険な走行を続けていた車から市民らを守るための正当な発砲だった」などとして無罪判決を求めるとみられる。この日で結審し、２８日に判決が言い渡される。

　２人は０３年９月１０日午後６時４５分ごろ、大和郡山市で車上荒らしに関与した疑いのある逃走車に発砲。警官３人が撃った計８発のうち、２人が撃った弾が助手席の高壮日（そうじつ）さん（当時２８）の頭と首に１発ずつ当たって死亡させたとされる。

光市母子殺害事件の最高裁判決要旨

　２０日に言い渡された光市母子殺害事件の最高裁判決の要旨は次の通り。
　犯行時１８歳だった被告は暴行目的で被害者を窒息死させて殺害し、発覚を免れるために激しく泣き続けた生後１１カ月の長女も床にたたきつけるなどした上で殺害した。
　甚だ悪質で、動機や経緯に酌量すべき点は全く認められない。何ら落ち度のない被害者らの尊厳を踏みにじり、生命を奪い去った犯行は、冷酷、残虐で非人間的。結果も極めて重大だ。
　殺害後に遺体を押し入れに隠して発覚を遅らせようとしたばかりか、被害者の財布を盗むなど犯行後の情状も悪い。遺族の被害感情はしゅん烈を極めている。
　差し戻し控訴審で、故意や殺害態様について不合理な弁解をしており、真摯（しんし）な反省の情をうかがうことはできない。平穏で幸せな生活を送っていた家庭の母子が白昼、自宅で惨殺された事件として社会に大きな衝撃を与えた点も軽視できない。
　以上の事情に照らすと、犯行時少年であったこと、被害者らの殺害を当初から計画していたものではないこと、前科がなく、更生の可能性もないとはいえないこと、遺族に対し謝罪文などを送付したことなどの酌むべき事情を十分考慮しても、刑事責任はあまりにも重大で、差し戻し控訴審判決の死刑の量刑は、是認せざるを得ない。
　【宮川光治裁判官の反対意見】
　被告は犯行時１８歳に達していたが、その年齢の少年に比べて、精神的・道徳的成熟度が相当程度に低く、幼い状態だったことをうかがわせる証拠が存在する。
　精神的成熟度が１８歳に達した少年としては相当程度に低いという事実が認定できるのであれば「死刑を回避するに足りる特に酌量すべき事情」に該当しうる。
　被告の人格形成や精神の発達に何がどう影響を与えたのか、犯行時の精神的成熟度のレベルはどうだったかについて、少年調査記録などを的確に評価し、必要に応じて専門的知識を得るなどの審理を尽くし、再度、量刑判断を行う必要がある。審理を差し戻すのが相当だ。
　【金築誠志裁判官の補足意見】
　人の精神的能力、作用は多方面にわたり、発達度は個人で偏りが避けられないのに、精神的成熟度の判断を可能にする客観的基準はあるだろうか。
　少年法が死刑適用の可否について定めているのは１８歳未満か以上かという形式的基準で、精神的成熟度の要件は求めていない。実質的な精神的成熟度を問題にした規定は存在せず、永山事件の最高裁判決も求めているとは解されない。
　精神的成熟度は量刑判断の際、一般情状に属する要素として位置付けられるべきで、そうした観点から量刑判断をした差し戻し控訴審判決に、審理不尽の違法はない。

菊川前会長、外部協力者ら計７人逮捕

　光学機器大手「オリンパス」の損失隠し事件で、東京地検特捜部は１６日午前、同社の前会長・菊川剛（７０）、前常勤監査役・山田秀雄（６７）、前副社長・森久志（５４）ら３容疑者を金融商品取引法違反（有価証券報告書の虚偽記載）容疑で逮捕した。


　損失隠しの「指南役」とされる大手証券会社元社員ら外部協力者４人についても、警視庁と合同で同日、逮捕した。

　関係者によると、旧経営陣３人は特捜部の任意の事情聴取に対し、いずれも容疑を認めていたが、特捜部などは巨額の損失を長年にわたって隠蔽した行為は悪質と判断。損失隠しで中心的な役割を果たした３人を取り調べ、複数の海外ファンドを利用した巧妙な損失隠しの全容解明を目指す。

　こういうものを平気で出してきたところを見ると、「大阪維新の会」の実態は、疑似「共産主義」、あるいは「国家社会主義」志向だと批判されても、反論は難しいだろう。そうでなければ、こうした政策志向が持つ思想上の意味を全然、理解していなかったかである。

とまで、結論づけるにはまだ早かろう。
むしろ、櫻田氏が拙速に結論を出そうとする動機のほうに興味がある。

Italian prosecutors began an appeal Tuesday against the acquittal of American Amanda Knox and her former boyfriend for the murder of British student Meredith Kercher.

Prosecutors in Perugia filed the 111-page appeal to Italy's highest criminal court, the Court of Cassation in Rome, more than four months after Knox had her guilty verdict and 26-year prison sentence overturned.

Raffaele Sollecito, her former boyfriend, also had his guilty verdict and 25-year jail sentence quashed.

Kercher, 21, was found stabbed to death in the house she shared with Knox and two other women in Perugia in 2007. Her body bore more than 40 injuries and lay in a pool of blood on the floor.

Prosecutors claimed that she had been killed during a drug-fuelled, frenzied sex attack by Knox, Sollecito and a third attacker, a local drifter named Rudy Guede. Guede, originally from the Ivory Coast, is serving a 16-year sentence - reduced on appeal from 30 years.

The convictions of Knox and Sollecito were thrown out by an appeals court in October, with the judges and jury deciding that the DNA evidence and witness testimony used to convict them were unreliable.

But Giovanni Galati, a Perugia prosecutor, insisted yesterday that the acquittal contained "omissions and many mistakes" and said he was "convinced" that Knox, 24, and her then-boyfriend carried out the killing. Their acquittal was "contradictory and illogical," he said.

The Court of Cassation is expected to make a ruling on the case toward the end of the year.

If the court's panel of senior judges accept prosecutors' arguments, then a retrial could be ordered. Prosecutors would then request Knox's extradition from the U.S. under a 1984 treaty between the two countries.

It would be up to the discretion of U.S. authorities as to whether they approved the extradition.

The latest appeal is the third and final judicial stage of a saga that has gripped public interest on both sides of the Atlantic for more than four years. Knox continues to enjoy her freedom in her native Seattle and was photographed recently cycling around the city.

Drawing on the diaries she kept behind bars, she is writing a book about her experiences, which is believed to be the subject of a multimillion-dollar bidding war by U.S. publishers.

"I resent the implication that because I'm coloured I must be an international visitor," said Kang. The three claim that after being denied entry, they expressed a concern to the bouncer of being turned away due to their Asian ethnicity. The bouncer allegedly replied "That's right, spread the word." The three, all Canadian citizens between the ages of 26 and 28, have filed human rights complaints against the Palace through the Alberta Human Rights and Citizenship Commission. Palace night manager Tony Evangelista dismissed the allegations. "Nothing's going to come of it," he said. "Simply put, they're pissed off because they didn't get into the club. We're a private club. We're allowed to deny entrance to anybody."

The Meyer content analysis found that during three months last year, the largest block of news stories involving black men and youth were about crime -- 86 percent of the news broadcasts and 37 percent of the newspaper stories. "And crime coverage featuring black men tended to get more prominent play in the news, with the stories more likely appearing atop the news page or at the beginning of the newscast," the report said. The Pew report found that the most frequent topics for news broadcasts involving African-American men were sports (43 percent) and crime (30 percent). In the newspapers, crime led all topics involving black men at 43 percent. Once crime stories were excluded, the content analysis found there were few other stories about black males. The Coyotes sent KTAR this statement supporting Torres and his wife: "There was absolutely nothing racist about Raffi or his wife's costumes. Raffi is a huge fan of Jay Z and his wife loves Beyonce. It was a Halloween party. The fact that this was reported is ridiculous."

The first concerns the wider social and economic environment. Across Europe, conditions remain ripe for the far right. Large numbers of citizens remain deeply concerned about immigration, feel anxious about the cultural compatibility of Muslims, and are threatened by rising diversity. In fact, in recent years the Brits have become equally if not more concerned about these issues than many of their European neighbours. These voters are also extremely dissatisfied with the response of the main parties to such trendsThe financial crisis has certainly added to this perfect storm, but far-right supporters were pessimistic about their economic prospects long before the collapse of the Lehman Brothers. The key issue is how to respond to voters' profound anxiety about this issue. This not simply affecting older generations. Far from a passing fad, the potential for far-right extremists is reflected in the demographics of their support. Last year in Austria, the Freedom party was the most popular party among those aged under 30, while today almost three-quarters of English Defence League (EDL) members are in the same age bracket. These findings point toward a clear conclusions: the far right is connecting with a new generation. The second concerns the potential for violence. Movements such as the BNP and EDL might not pursue overtly violent goals like AQ-inspired terrorists, but the wider subculture in which they are embedded is characterised by a culture of violence, which cultivates a set of narratives among supporters that would justify its use under certain conditions: it tells them that they and their loved ones are under threat from minority groups; that they will soon be involved in a race war; and that urgent and radical action is required to save them from racial extinction. The line between nonviolent protest and violence has already been crossed by "lone wolves" such as Anders Behring Breivik and, in the UK, affiliates of the Aryan Strike Force (ASF), Racial Volunteer Force (RVF) and the BNP. The third concerns our current understanding of this challenge. As the previous Prevent strategy conceded, our knowledge of the far right is much less developed than our understanding of AQ-inspired terrorism. The good news is that we do now know a lot more about what leads some citizens into the far right. This year alone has seen new research on the BNP, members of the English Defence League and populist extremism across Europe. But the evidence base remains inadequate: we know next to nothing about how those voters compare with far-right violent extremists, or the factors that lead citizens toward one form of activity as opposed to the other.

One commenter wrote, “People need to grow thicker skin, get a sense of humor and stop yelling racism at every little thing.”

ホルムズ海峡に自衛隊派遣を…米太平洋軍司令官

　米太平洋軍のロバート・ウィラード司令官は、都内で読売新聞と会見し、イランがペルシャ湾入り口のホルムズ海峡の封鎖を警告していることについて、「情勢は極めて深刻だ。日本を含め、全ての国が注目する必要がある」と指摘した。


　そのうえで「日本政府が判断することだ」としながら、「あの地域で起きていることが日本にも影響することを考えれば、イランを抑えようとしている国際社会の取り組みを日本が支援することは非常に重要だ」と述べ、日本政府がこの地域への自衛隊派遣を検討するべきだとの考えを示した。

　司令官は「イランのような国に日米がどう共同対処するか、日米同盟の真価が問われる。両政府にとっても試金石だ」と強調した。

無抵抗のネパール人を執拗に暴行…殺人罪適用

大阪市阿倍野区の路上で、ネパール人の飲食店経営・ビシュヌ・プラサド・ダマラさん（４２）が暴行されて死亡した事件で、大阪地検は６日、彫り師白石大樹（２１）、無職白石美代子（２２）両容疑者を殺人罪で起訴した。


　無抵抗のダマラさんの頭や顔を執拗に殴る蹴るなどした暴行の客観的状況から、地検は殺意があったと判断したとみられる。

　起訴状では、両容疑者は建築工伊江弘昌容疑者（２１）（殺人容疑で逮捕）と共謀。１月１６日午前４時２０分頃、同区の路上で通りすがりのダマラさんら３人に言いがかりをつけ、逃げるダマラさんを引き倒し、頭や顔を多数回殴る蹴るなどした上、自転車を投げつけるなどの暴行を約１０分間にわたって加え、外傷性急性脳腫脹で死亡させ殺害したとされる。

　大阪府警は先月、両容疑者ら４人を逮捕。両容疑者と伊江容疑者は府警の調べに暴行を認めたが、殺意は否認していた。地検は両容疑者の認否を明らかにしていないが、現場の防犯カメラが約１分半の間に約４０回もダマラさんを暴行する姿をとらえており、１１日に勾留期限を迎える伊江容疑者との共謀で起訴した。

覚醒剤密輸、過去最多の１８５件…欧州人急増

　昨年１年間に税関当局が全国の空港や港で摘発した覚醒剤の密輸件数は前年より３３件増の１８５件で、過去最多だったことが財務省関税局のまとめでわかった。


　欧州の若者が旅行客を装って持ち込むケースが目立っており、同局は「ユーロ危機による不況で、仕事が見つからない欧州の若者が運び屋になっているのではないか」と分析している。

　同局によると、押収量は計約４０２キロで、前年より約８０キロ増えた。摘発された１８５件のうち１４１件（１４１人）は航空機で来日した旅行客が、手荷物に紛れ込ませたり、のみ込んだりして持ち込んでいた。

　昨年５月にスーツケースの底に覚醒剤約１・９キロを隠したチェコ人の女（２３）が摘発されるなど、１４１人のうち６４人の国籍はイタリアやルーマニア、ドイツ、ベルギーなど欧州諸国で、前年の３６人から急増した。

　国際結婚が破局した際の子どもの扱いを定めた「ハーグ条約」の加盟に向けて、法制審議会は７日、国内で整備が必要な裁判手続きなどの要綱を小川敏夫法相に答申した。これを受け、政府は３月中に法案を提出し、今国会での条約承認を目指す予定。ただ、他の重要課題も多く、法案成立と承認の見通しは立っていない。

　ハーグ条約は、国際結婚が破局するなどして一方の親が１６歳未満の子を無断で国外に連れ出した場合に、子を元の居住国に戻し、その国の裁判で誰が子の面倒を見るかを決めるよう定めている。主要８カ国（Ｇ８）では日本だけが未加盟。欧米諸国から早期の加盟を求められ、日本政府は必要な国内法の整備を急いでいる。

　要綱は、日本人の親が日本に連れ帰った子を外国にいる親が戻すよう求めた場合の手続きを規定。家裁が子を戻すかを決定し、従わなければ裁判所の執行官が強制的に子を引き離せる仕組みも盛り込んでいる。

足ひかれて１５０ｍ追跡、女性の胸ぐらつかむ

　島根県警松江署は１日、松江市大正町、会社員青山春樹容疑者（２０）を傷害容疑で逮捕した。


　発表によると、青山容疑者は１月８日午後６時頃、松江市朝日町の市道を歩いていた際、横を通り過ぎた車を呼び止め、運転していた同市春日町の無職女性（５９）の胸ぐらをつかんで、揺すったり拳を押しつけたりして全治３週間のけがを負わせた疑い。

　同署によると、女性の車が青山容疑者の脇を通過しようとした際、トラブルになり、青山容疑者の右足をひいたという。青山容疑者は約１５０メートル走って追いかけ、信号待ちしていた女性の車を停止させた。青山容疑者は右足に全治２週間のけがを負っており、「危ないと思ってやった」と話しているという。女性は同２５日、自動車運転過失傷害容疑で松江区検に書類送検されている。

警察が調べた遺体、過去最多の１７万人　孤独死など背景
　死因が不明、または事件性があるなどの理由で警察が調べた遺体の数が、２０１１年は１７万３７３５体となり、記録が残る９８年以降で過去最多だったことが警察庁のまとめでわかった。誰にもみとられずに亡くなる人が増えたことなどが背景にあるとみられる。

　統計には、東日本大震災の被災者と交通事故による死者は含まれていない。

　殺人などの犯罪による遺体は、近年の刑法犯減少を背景にほぼ毎年減っており１１年は７３５体。０２年の約４割で、過去最少だった。2012年2月2日22時49分

捜査機関の通信傍受、１０件、２２人逮捕

法務省は３日、捜査機関が昨年１年間に通信傍受法に基づき電話や電子メールを傍受した事件は１０件で、逮捕者は計２２人だったと発表した。傍受に必要な裁判所の令状発付は２５件。２７件を請求したが、２件却下されたという。平成１２年の同法施行後、傍受を実施した事件は計６７件で、逮捕者は計２６９人となった。

　法務省刑事局によると、対象はすべて携帯電話。傍受した通信は計８４４２回で犯罪関連は７６３回だった。薬物密売５件、拳銃所持３件、組織的殺人２件。全て警察当局の事件だが事件ごとの捜査機関や逮捕者名は明らかにしていない。

　ある薬物密売事件では２台を対象とし、それぞれ１０日間実施。計１１２８通信を傍受し、うち４７回が犯罪関連で計１０人を逮捕した。一方、拳銃所持事件と組織的殺人事件では犯罪関連の通信はゼロで逮捕に至らなかった。

「休まれると支障」と解雇の育休女性、主張通る

　育児休業を理由とした解雇は違法として、埼玉県内の女性（３２）が、勤務していた「埼玉土地家屋調査士会」（さいたま市浦和区）などを相手取り、復職と慰謝料１６５万円などの支払いを求めてさいたま地裁に起こした民事訴訟は、同会が１日付で女性の主張を全面的に認める「認諾」をしたため、終結した。


　同会は、慰謝料と未払い賃金・賞与の計４００万円を支払うことで合意し、女性が近く復職するよう調整中という。





武道の必修化　「安全」に不安残る柔道の指導（2月5日付・読売社説）
　中学校における武道の必修化が、４月に迫っている。

　安全に十分配慮した指導方法を確立することが急務である。

　男女とも１、２年生の体育の授業で原則、柔道、剣道、相撲のいずれかを学ぶ。

　武道は日本固有の運動文化だ。必修化には、礼を重んじる態度を育むとともに、生徒の体力を向上させる狙いがある。

　ただ、事故の危険もつきまとうため、保護者からは不安の声も上がっている。特に懸念されているのは柔道だ。

　名古屋大学の内田良准教授（教育社会学）の調査では、部活動や体育授業中の柔道事故で死亡した中学・高校生は、２０１０年度までの２８年間に１１４人いた。大半は部活動中の事故だった。

　手足のまひなどの後遺症が残った事故も、０９年度までの２７年間に２７５件起きているという。

　死亡した中高生のうち１年生が半数以上を占める。専門家は「受け身を習得していない初心者が事故に遭いやすい」と指摘する。

　柔道は剣道に比べ、防具などをそろえる必要がない。このため、多くの学校が必修の種目に選ぶと予想されている。女子も対象だ。何よりも、事故が起きないように細心の注意を払って指導にあたる必要がある。

　個々の生徒の体力や技量を見極めて無理をさせない、休憩や水分補給をとらせる、といった基本の再確認が欠かせない。けがの際の応急措置や、医学知識を身につけておくことも必須と言える。

　柔道経験の乏しい体育教師が、教える立場になるのも心配だ。

　全日本柔道連盟が授業方法の教本や安全指導の手引書を作った。各地の教育委員会でも、柔道の指導法の研修を実施している。

　だが、それだけでは十分ではない。地域の柔道教室の講師や、柔道経験の豊富な警察官ＯＢなどを外部指導者として招くことが有効だろう。経験を生かし、体育教師と一緒に指導にあたれば、事故防止にもつながる。

　文部科学省は、これまで必修化に向けた準備を学校現場に委ねてきた。柔道指導の経験のある教師数も確認していなかったのは問題ではないか。

　事故例を分析した上で、具体的な事故防止策を示すなどの情報提供をしていくべきだ。

　事故が起きてからでは遅い。文科省は学校現場の準備状況を把握し、場合によっては、安全指導の確立に、さらに時間と手間をかけることも必要だろう。

殴る蹴る４０回、自転車も…ネパール男性暴行死

　大阪市阿倍野区の路上でネパール人の飲食店経営ビシュヌ・プラサド・ダマラさん（４２）が暴行されて死亡した事件で、殺人容疑で逮捕された白石大樹容疑者（２１）らによる犯行状況の詳細が、大阪府警の調べなどでわかった。

　逮捕された男女４人のうち、白石容疑者ら３人は殺意を否認し、１人は暴行への関与自体を否定。これに対し府警は、白石容疑者らには少なくとも「死ぬかもしれないが、それでも構わない」との「未必の殺意」があったとみている。大阪地検は６日、勾留期限を迎える白石容疑者ら男女２人について、殺人罪に問えるか否かを判断する。

　捜査関係者によると、白石、伊江弘昌（２１）両容疑者らは１月１６日未明、偶然通りかかったダマラさんと、ネパール人の男性従業員２人を襲撃。逃げるダマラさんを約８０メートル南東の路上で捕まえ、引きずり倒した。

　この際の様子は、付近の駐車場の防犯カメラがとらえていた。映像には、白石容疑者らが約１分半の間に約４０回、ダマラさんの頭を蹴ったり跳び上がって体を踏みつけたりして暴行する様子が映っており、上半身をめがけて自転車を３回たたきつける場面もあった。

　ダマラさんはその後、よろめきながらも逃げ、白石容疑者らもいったん、その場を離れようとしたが、従業員がダマラさんの所に戻ってきたことに気付き、引き返して再び暴行。ダマラさんは、脳が急激に腫れて頭蓋骨に圧迫される外傷性急性脳腫脹
