◇政府は受け入れ態勢整備を 　国内最大の中華街を抱える横浜市で、中国出身の児童・生徒が急増している。日本政府が、コックなど特殊技能者の就労ビザ規制を緩和した００年ごろからだ。中華街から西に約１キロの市立富士見中学校（同市中区）は今年度、「外国籍」の生徒と、父か母のどちらかが外国人など「外国につながる」生徒の割合が計４２％に上った。日本語が話せない生徒が多いため学校側は悲鳴を上げる。子供たちは自分から望んで来日したわけではない。政府が認めて受け入れているのだから、文部科学省は彼らの来日後の日本語教育もきちんとケアすべきだ。 ◇卒業までに習得、２０人に１人程度 　教室内では中国語が飛び交い、帰宅後も両親は共働きで深夜まで留守。そんな中、アパートで一人、常時中国とつながっているインターネットに向かい続ける−−。市関係者から聞いた、来日まもない中国人中学生の典型的なイメージだ。現実には、これが２年も３年も続く。 　横浜市は市立の小中学校に「外国籍５人で１人、２０人以上で２人」の担当教師を置く「国際教室」を設け、中国語など外国語のできる教師やボランティアが個別指導で補習を行っている。しかし、日本人の中学生が渡米しても容易に英語ができるようにならないのと同じように、来日した中学生が１、２年で日本語を習得することは、とても無理だ。「２０人いて卒業までに１人が習得できるかどうか」（市関係者）という状況にある。 　横浜市は韓国やフィリピン、南米系住民も多く住む国際都市だ。中心部の中区や南区は、近くに中華街があることから大半の外国人が中国系。中国人はビザを得ると、まず夫婦で来日し、日本永住を決意したら子供を呼ぶ。職場は中華街でのコック、食器洗いや配膳、中華食材工場などが多い。富士見中は学区内に日本有数の日雇い労働者の街とされる寿町地区を抱え、かつては、その子弟が生徒の大半を占めていたが、近年は寿町全体が高齢化したため、代わって中国系の生徒が増えた。 　彼らは日本のマンガやアニメ、歌が好きで、多くが日本にとどまりたいという。しかし、日本語ができないため、「日本のことを知りたいが、勉強はあまりしたくない」という子が目立つ。横浜市国際交流協会（ＹＯＫＥ）の木村博之課長代理は「彼らが日本語を話し日本シンパとなれば、日中両国にとって大きな財産になる」と語る。 　日本政府には、経済産業省に代表される「外国人を国内労働市場に積極的に受け入れるべきだ」と、厚生労働省に代表される「国内の労働者のことを考えれば、受け入れるべきではない」という相反する二つの声がある。横浜市の中国人コックらは特殊技能労働者としてインドネシアやフィリピンからの看護師らと同様、「積極受け入れ」の声に押される形で入国している。 ◇労働力ではなく、人間として扱え 　私はかつて働き手を送り出すアフリカと旧植民地から大量の移民を受け入れてきたフランスに駐在した。アフリカには受け入れ先さえあれば、ほぼ無限ともいえる人たちが渡航を希望する現実がある。フランスはじめ欧州各国は、かつては寛容に海外の働き手を受け入れた。しかし今や特殊技能者に制限する傾向にあり、それさえも入国は難しくなってきている。「異文化融和」の理想は美しい。しかし現実に移動するのは単に「労働力」だけでなく「人とその家族ら」であり、そこに、多くの問題が発生する。 　外国人労働力の受け入れの是非を巡っては、さまざまな論点がある。容易に結論は出ない問題と分かった上で、あえて日本政府は基本方針を提示してほしいと言いたい。それがないままに国際学級の教員数や看護師試験の出題言語を一部変更したとしても、本末転倒だ。そして、受け入れを決断したなら彼らを「労働力」でなく「人間」として扱い、家族を含めた社会保障や子弟の日本語教育など、制度としてきっちりケアする態勢を整えるべきだ。 　横浜市には開港以来、外国文化を受け入れてきた伝統があり、中国語をはじめ外国語を話すボランティアが積極的に活動している。それでも入国者の多さに対応は全く追いついていない。１０代の青少年は多感で、学習だけでなく、個々の悩みへの対応も必要だ。自宅で深夜までネットに向かう生徒たちが直接中国語で相談できるよう、ネーティブの担当者がもっと必要だ。態勢ができていないのに、規制緩和で来日者数ばかり増えるのはおかしい。 　「大人の来日は自己責任だが、子供たちには絶対にサポートが必要」。そんな中国人ボランティアの言葉が、耳から離れない。

(Mainichi) 拡大写真 YOKOHAMA -- Kanagawa's capital city of Yokohama, which boasts the country's largest Chinatown, has seen a surge in the number of Chinese children and students. The trend began in around 2000, when the Japanese government relaxed its restrictions on work visas for cooks and other skilled workers. At Fujimi Junior High School, a public school about a kilometer west of Chinatown, students who are foreign nationals themselves or whose father or mother are foreign nationals now comprise 42 percent of the student population. The school is overwhelmed, unable to deal with so many students who do not speak Japanese. Since the Japanese government grants these students, who do not come to Japan of their own volition, the permission to enter and reside in this country, shouldn't the Education, Culture, Sports, Science and Technology Ministry provide them with comprehensive Japanese language instruction after they arrive? According to one Yokohama city official, the typical recently-arrived Chinese student will spend much time in school speaking in Chinese with their compatriots. After school, they will return to an empty home and spend time on the Internet -- which offers constant connections to China -- until their parents return from work late at night. This state of affairs may last two to three years for many Chinese students in Japan. At municipal elementary and junior high schools, the Yokohama Municipal Government places specialized staff, who are generally teachers and volunteers that speak Chinese or other languages, in what are called "international classrooms." One staff is allocated if there are five foreign students, and two specialized staff when the number of foreign students reaches 20 and over. In these classes, students are given individualized remedial instruction. However, just like a Japanese junior high school student who goes to the United States will not learn to speak English right away, a Chinese student who comes to Japan will not learn to speak the Japanese language after a mere year or two. "Barely one student out of 20 will acquire the language before graduation," one city official said. Yokohama is an international city that in addition to many Chinese, hosts residents from South Korea, the Philippines, and South America. Of the foreign nationals in Naka and Minami wards, in central Yokohama, many are Chinese, because of their proximity to Chinatown. In general, the Chinese first apply for visas as married couples. After they enter the country and later make the decision to live permanently in Japan, they send for their children in China. Many of these people work as cooks, dishwashers, and waiters in Chinatown, or workers at Chinese food processing factories. The school district where Fujimi Junior High is located covers an area called Kotobukicho, which has one of the highest concentrations of day laborers in Japan. In the past, most of Fujimi Junior High's students had been the offspring of these laborers. The general aging of the local population in recent years -- and therefore the drop in the number of local students -- overlapped with the upsurge in Chinese students. Many of these Chinese students like Japanese manga, anime, and music, and many say they want to stay in Japan. However, because a large number of them do not understand Japanese, they say they don't want to study even though they want to learn more about Japan. "If these students were to learn to speak Japanese and became pro-Japanese, they would become highly prized figures in the realm of Japan-China relations," says Hiroyuki Kimura of the Yokohama Association for International Communications and Exchanges (YOKE). There are two opposing forces within the Japanese government regarding immigration. One is represented by the Ministry of Economy, Trade and Industry, which calls for the aggressive recruitment of foreign nationals into the Japanese job market. The other is held by the Health, Labor and Welfare Ministry, which objects to foreign recruitment to protect Japanese workers. Chinese cooks, as well as Indonesian and Filipino nurses, come to Japan backed by the former. I was once stationed as a reporter in France, where many Africans and immigrants from former colonies have been permitted to enter its borders. Even now, there are many Africans who would immigrate in a flash as long as someone was willing to take them in. But the willingness of France and many other European nations to accept workers from foreign countries is no longer what it used to be. They are restricting immigration to those with special skills, and even then, it has become increasingly difficult. The integration of different cultures is a beautiful ideal. However, "labor" is not the only thing that moves when immigration takes place. It entails the movement of people and their families. Various viewpoints exist on the pros and cons of foreign labor. Knowing full well that it is an issue with no easy answer, I urge the Japanese government to establish a basic policy. Merely setting up "international classrooms" in schools or tweaking the language used in national nursing exams for foreign nurses without instituting a basic policy is putting the cart before the horse. And if the government decides to fling open Japan's borders to foreign workers, it must treat them not as "labor," but as human beings, and provide them with a framework in which they and their families are offered social security, Japanese language instruction, and other assistance. Yokohama has been open to foreign cultures ever since its port was opened to the outside world in the mid-19th century. There are many volunteers who speak Chinese and other languages, who assist non-Japanese speakers through various activities. Such efforts, however, do not stand a chance against the rapidity with which the foreign resident population is growing. The teenage years can be vulnerable ones, making it particularly important to provide teenagers with personal assistance in their studies and other areas of their lives. There is a desperate need for native Chinese speakers that the Chinese junior high students, who spend their evenings on the Internet, can reach out to for advice. It's absurd that immigration laws were relaxed without Japan fully preparing for the influx of foreign nationals that has followed. These words, spoken by a Chinese volunteer I met, have left a lasting impression on me: "Coming to Japan is one's own responsibility among adults, but when it comes to children, they absolutely need support." Hippler, who is president of Karlsruhe Institute for Technology, said universities should be dissuaded from teaching courses entirely in English, and that the risk of this contributing to the decline of German was something institutions “should be aware of.” He admitted that there were many international students who come to Germany and want to stay, but many take courses taught entirely in English, thus learning little German. “A German language qualification should, sooner or later, be required from everyone,” Hippler told the paper. Hippler said that although “publishing scientific work in English makes sense,” abandoning German completely is a mistake. This not only creates a false idea of what is “international”, but also deprives lecturers of being able to bring a depth to their classes in a way only someone’s mother tongue allows. This “really is a problem,” he added. Elsewhere in the interview, Hippler touched on his intention to reopen the debate on university fees in Germany. He believes that without reassessing how higher education is funded, the system “could collapse.” With the student population expanding rapidly, a squeeze in funding is to be expected, he said, and students should expect to carry some of the burden. “We are not talking about horrendously high fees, but about students contributing,” he said. Last month new figures showed that although 80 percent of foreign students who complete courses in Germany would like to stay, only about a quarter do, with lack of bureaucratic help in English cited as one of the problems they face.

CLARKSVILLE, IA-It's common to hear about bullying and hate crimes across the nation. In one high-profile case a former Rutgers University student was found guilty posting video online of his roommate kissing another man. The roommate later killed himself. But crimes like that also happen here in our area. A Clarksville man says he was attacked because of his sexuality back in 2010. The case has been working its way through the court system since then. But now he wants people to know this problem hits close to home. Headline after headline showing the tragedies of people that were bullied or a victim of a hate crime. Travis Bouska says he is one of those impacted by the growing issue. Bouska says, "A gentleman came in there and came directly towards me and swung at my face and hit me and caught me on the side of the face. The whole time he was screaming and yelling that I’m going to kill you faggot. The next time I see you up town you queer you are dead.” All because of his sexuality. Bouska is gay. But says that's not what defines him. Bousak says, "It’s part of that person's life. But like I said it's not who I am. I'm still the same son and brother and neighbor funeral directors at work. You know, I do everything the same as a quote straight person would do." But it has made him the subject of hateful actions in his community. Something he says has tested his will to go on.

Seminole, Florida -- A Seminole man was arrested in Montana Monday after police say he stalked and harassed his former neighbors, an interracial couple, with hate mail for almost two years. According to the Pinellas County Sheriff's Office, Allan Dale Richter sent his former neighbors, Amy Query and Nathan Maingi, 20 hate-filled, threatening letters between July 2010 and March 2012. Some were sent by mail and others were left on their doorstep. "It really triggered every emotion. It was very scary," Query described. A break in the case came when a partial fingerprint was lifted from one of the letters that matched those of Richter's, a nearby neighbor of the couple during part of the time in unincorporated Seminole. "This person walked up to our door. What else could they do?" Maingi described of the couple's thought process through the ordeal. The couple says the letters completely changed their lives. They installed security cameras, didn't trust neighbors, even canceled meetings with business clients out of fear. They also have a 10-month-old daughter. "We wouldn't come home after dark. We always looked around to see who is riding around, walking around the neighborhood," Maingi said.

PRETORIA (Reuters) - Foreign-born athletes who have taken UK citizenship ahead of the 2012 London Olympics have been dubbed "Plastic Brits" by critics but the most famous sportswoman to have made that journey is sympathetic. For 45-year-old South African Zola Pieterse, better known by her maiden name Budd, the reasons behind the move are understandable - money in an age of rampant sports commercialisation as well as a desire to compete. "If you look at running as a business then it is unfair to bar people from running at whatever level they want just because they're not eligible," she told Reuters in an interview. "You can't really blame people for trying to get into the Olympic Games." Budd bursted on to the global stage as a barefoot teenager in the early 1980s when South Africa was barred from international sport because of apartheid. She ran in the 1984 Los Angeles Olympics for Britain and was leading the 3,000 metres final when she became involved in a dramatic collision with American Mary Decker. Decker was felled and could not finish while Budd was, in the eyes of many fans, unfairly blamed for the incident. Visibly rattled, she finished seventh but went on to become a double world cross-country champion. "The Olympic Games today is not the Games it was 20, 30, 40 years ago," said Budd. "If somebody wins a gold medal in the Olympics it means a lifelong way for them to earn money so there is so much more at stake now." Budd said critics should also consider the time and effort that goes into top-level sport. "If it weren't that commercialised I don't think anyone would be interested in performing and putting so much effort into it because it won't be worth putting your money into it or your time. Rather than put it into a career," she explained. Budd has been living with her family in South Carolina for four years and a lot of water has gone under the bridge since the Los Angeles Games when she was vilified by the U.S. media. "It's a much lower profile for me now. It's been a few years since the 84 Olympics and it's nice just to live a quiet life in Myrtle Beach where no one more or less knows you and I can just live a normal life," said Budd. The country is now heading down the path well trampled by the likes of Bahrain and Qatar where overseas medal prospects are lured in. It's cheaper and quicker than developing athletes, but how much pride would the nation take in following the sort of practices employed by Russia, for instance, who recently gave a South Korean three-time gold medal speed skater special dispensation to become a citizen in time for the 2014 Winter Games - which happen to be in Russia. The UK is not far off that kind of cynicism. Out of around 550 members of Team GB, approximately 50 will be foreign-born athletes with dual nationality who jumped on board the Olympic bandwagon after London was selected to host the Games. Britain has imported the wrestling team almost as a job lot from Ukraine and Bulgaria. Add to that a British handball team that has 19 foreign-born players, mostly from Scandinavia; a British basketball side that has 10 players born as far afield as Nigeria, Holland, Sudan and Canada, and nine more foreign-born competitors in the GB volleyball side and it's clear the team meeting will resemble Heathrow Airport's Terminal Three during a baggage handlers strike. If the concept of nationality is watered down any further and talent continues to be effectively 'bought', the whole Olympic ethos essentially become meaningless. One could argue athletes might as well dispense with the flag and just run or compete for themselves, not their country. But then some appear to be doing that already.

Study: One in Three Americans Fails Naturalization Civics Test

By BRIAN GREENE April 30, 2012 RSS Feed Print As Americans prepare to pick the next president of the United States in November, a survey out of the Center for the Study of the American Dream at Xavier University finds that one out of three U.S. citizens fails the civics portion of the immigrant naturalization test. The survey of more than 1,000 voting-age Americans asked respondents 10 random questions from the United States Citizenship and Immigration Services civics exam, which is administered as part of the immigration process, finding that 35 percent answered five or less questions correctly. More than 97 percent of immigrants applying for citizenship pass the test. [See a collection of political cartoons on immigration.] Native-born citizens fared best on questions related to history and geography and struggled most with questions about the function of government, specifically on questions about the Constitution and those that asked to identify current policy-makers. Other parts of the study show respondents were overwhelmingly confused about powers granted to the federal government and those granted to individual states. Here are some questions that gave respondents the most trouble: 85 percent could not define "the rule of law." 75 percent did not know function of the judicial branch. 71 percent were unable to identify the Constitution as the "supreme law of the land." 63 percent could not name one of their state's Senators. 62 percent did not know the name the Speaker of the U.S. House of Representatives. 62 percent could not identify the Governor of their state. 57 percent could not define an "amendment." A concurrent survey found that almost 77 percent of Americans believe that all native-born citizens should be able to pass the civics portion of the naturalization test and 60 percent think that passing it should be requisite for receiving a high school diploma.

“And we should all give a big hand to Adelstein for taking the stand he’s taking.” Well, yes and no. Much as CJ is something of a special head-case and engages in libel throughout the article, he does actually raise some fairly legitimate points about Adelstein’s journalistic practice. He’s right in stating that some pretty well-known newspapers accepted the story about Goto that had barely verifiable sources. And in a few cases, such as the National Geographic episode, CJ seems really to have done his homework. I also had similar thoughts about the self promotional nature of Adelstein book affecting his status as a journalist, particularly in his book. Also, some of the reasons for not quoting his sources, as CJ mentioned, are pretty weak. I can’t trust what he writes, which is, let me be clear, a different thing altogether from saying he is a liar. What he writes may well be true, but the evidence is pretty thin. This kind of looks like a sort of bonfire of vanities to me, with Adelstein being the slicker operator of the two and with CJ’s name already mud.

Since Japan does not have as many journalism schools or press watchdog groups as other countries, many journalists feel that the work of NHK, Nikkei, Asahi, Mainichi, Kyodo and Adelstein's former employer, the Yomiuri, often falls below the standards of small town or even college papers at journalism schools in North America. One mainstream media article this year, about the detention of French journalists working in Fukushima, basically boiled down to this: Japanese daily cites unnamed sources making unproven accusations against unnamed journalists, whereabouts unknown. "Bokki", a commenter on www.fuckedgaijin.com, summed up what many trained and seasoned journalists feel about Adelstein:

With 80 per cent of citizens taking part in the vote, there is undoubtedly a notable presence of extremist and nationalist feeling in the ideological and political landscape throughout Europe. Germany recently allowed the re-release of the controversial Adolf Hitler book, Mein Kampf, and Norway is currently witnessing the trial of Anders Breivik, accused of murdering 77 people last year with overtly racist motives. These events reinforce the widespread fear that the old continent is increasingly giving the floor to far-right ideas.

It all started with the creation of a "ministry of immigration, integration and national identity", whereby immigration was erected to the status of an "issue". A series of anti-immigration laws were subsequently adopted. The first ones targeted mixed couples who dared to marry. According to President Sarkozy and his government, a foreigner is obviously not in love with the person he/she has decided to marry. In the name of the fight against "white marriages" - also known as marriages of convenience - mixed couples who decided to legally bind themselves had to undergo embarrassing and somehow humiliating controls to prove that they actually share their lives together and love each other. This process could involve answering questions on intimacy, telling how you met your beloved one, and all kind of personal memories one wouldn't easily share with an administration. Figures that prove "white weddings" represent such an overwhelming threat for the country have yet to be published.

Citizens who may not appear to have French nationality also have suffered from stigmatisation. When it's not their religion that allegedly prevents them from fully integrating French society, they see the sacrosanct principle of equality of all citizens suddenly stop at their door. In a July 2010 speech in Grenoble, Sarkozy said that any French citizen with foreign origins who was found guilty of a murder of someone working for the public authority should be stripped of their French citizenship, in addition to the penal condemnation.

It mattered that Sotomayor made the choice to use this language, because she’s made the choice to use other terminology before.

結論はシロだが、「潔白」ではなく「灰色」という司法判断だろう。 　資金管理団体・陸山会の土地取引を巡り、元秘書と共謀し政治資金収支報告書にウソの記載をしたとして政治資金規正法違反で強制起訴された民主党の小沢一郎元代表に、東京地裁が無罪を言い渡した。 　土地購入原資の４億円の不記載などについて、判決は「小沢氏は元秘書から報告を受け、了承していた」と認定した。検察官役の指定弁護士が「共謀が成立する」と主張したことには「相応の根拠がある」とまで述べている。 　ただし、こうした会計処理を違法であると小沢氏が認識していたことを示す立証は不十分だとして、最終的に共謀は認めなかった。有罪か無罪か、まさに紙一重の差だったことがうかがえる。 　判決は、秘書だった石川知裕衆院議員らがメディアからの批判を恐れ、小沢氏提供の４億円を意図的に隠蔽した、と指摘した。 　石川議員ら元秘書３人に対しては、１審・東京地裁が昨年９月、有罪判決を言い渡している。

元秘書の衆院議員、石川知裕被告は４億円提供と同時期、なぜわざわざ同額の銀行融資を受けたのか。 　判決は、目的について「提供を受けた４億円の簿外処理のため」としたうえで「元代表の個人資産から提供された事実が対外的に明らかになると取材などで追及され、元代表が政治的に不利益を被る可能性を避けるためだった」と動機を指摘した。 　４億円を記載しないことについて元代表への「報告・了承」があったのかについては「秘書らは自ら判断できるはずはない」と指摘し、元代表の了承を認定した。 　判決は、共謀の成立の検討について「相応の根拠がある」とも指摘した。だが、４億円の記載時期の先送りが虚偽記載になることを元代表が認識していなかった可能性などを指摘し、無罪の結論を導いた。 注目したいのは、判決が元代表に対して厳しい目を向けていることだ。元代表は法廷で、「報告・了承」があったことを全面的に否認した。だが、判決はこうした主張の核心部分を否定した。 　元代表の法廷発言に変遷があるとして、信頼性にも疑問を投げかけた。４億円の融資書類にサインした経緯を述べた法廷発言は「不自然」とし、「報告書は一度も見ていない」との発言についても、およそ信用できないとした。 　元代表は、政治資金の処理について「一切、秘書の自主判断でやってもらっていた」と法廷で発言した。秘書任せにしたことで、虚偽記載に至る具体的な事情が耳に入ることがなく、かえって刑事責任を問われずに済んだ。判決はそういった事情も書きこんだ。 　だが、秘書らを監督する政治家としての責任は別だ。石川被告ら元秘書３人は昨年、東京地裁で有罪判決を受け、控訴している。今回、判決が再度、元秘書らによる報告書の虚偽記載を認定した事実は重い。元代表の道義的責任は一層、強まったといえる。

Tim Sallinger WGN News 6:34 a.m. CDT, April 22, 2012 NORTH CHICAGO— The Reverend Jesse Jackson showed support for the family of a man who died while in North Chicago Police custody last Fall. He marched with relatives of Darrin Hanna during the "Ten Thousand Man March" Saturday. Marchers showed up at North Chicago City Hall, calling for the resignation of Mayor Leon Rockingham Jr. North Chicago Police arrested Hanna last November after reports that he was beating his pregnant girlfriend. Officers who showed up at Hanna's home claim that he rushed toward them with clenched fists, forcing them to defend themselves by hitting him with batons and a taser. Hanna died a week later. At an emotional press conference Friday, Jackson showed reporters photos of a bruised and bloodied Hanna, taken just after his arrest. He compared the images to those of murdered black teenager Emmett Till. "The criminals who engaged in this activity are still policemen. They still have a badge, and a gun, and authority," Jackson said. "We will not let these forces be on the loose, uniforms or not." The seven officers involved in Hanna's arrest have been re-assigned to desk duty while local authorities investigate. The U.S. Department of Justice confirmed Friday that it is conducting a preliminary inquiry into the case, which will determine whether there is a need for a formal investigation. Mayor Leon Rockingham Jr. said he welcomed the inquiry. "Hopefully, whatever conclusion they come to will bring some resolution and possibly calm the community." Recently released audio recordings from the arrest have Hanna pleading with officers, telling them "Put me down, please, I was down." Hanna's relatives have sued the city; their attorneys claim that the tape shows Hanna was cooperating with arresting officers. Also, an autopsy report found that Hanna had 11 taser marks on his back, while police claimed they only used it two or three times.

仙谷氏の名誉毀損、新潮社に賠償と謝罪広告掲載命じる　東京高裁判決 2012.4.24 17:43 　週刊新潮の記事で名誉を傷つけられたとして、民主党の仙谷由人政調会長代行が発行元の新潮社に１１５０万円の損害賠償などを求めた訴訟の控訴審判決が２４日、東京高裁であった。芝田俊文裁判長は「名誉毀損（きそん）の違法性が高い」として、１００万円の支払いを命じた１審東京地裁判決を変更、賠償額を３３０万円に増額し、同誌への謝罪広告の掲載も命じた。 　問題となったのは平成２２年１０月２８日号の記事。仙谷氏が逮捕歴のある金融業者と暴力団関係者のトラブルに絡み、弁護士として公的文書の偽造に関与したなどとする内容を掲載した。 　芝田裁判長は「記事は真実と認められず、主要部分に関し裏付け取材をほとんど行っていなかったと推認される」と指摘。記事掲載当時、仙谷氏が官房長官だった点に言及し「国権の最重要ポストという立場を考えると、社会的評価を著しく低下させる内容だった」と増額の理由を述べた。 　週刊新潮編集部は「到底納得できない。ただちに上告する」とコメントしている。

If you're concerned with how some factory farms might be handling their livestock, two US states have made it illegal to conduct undercover investigations — and now animal rights activists and whistleblowers alike have a bone to pick with lawmakers. Only four months into 2012, Utah and Idaho have passed legislation that outlaws going undercover to investigate conditions and conduct inside the confines of factory farms — and now authorities in Missouri are coming close to approving a similar “Ag-gag” act. If passed before the end of April, the Show Me State will become the third state in only two months to tell investigative journalists and whistleblowers alike to forego following leads concerning agricultural operations or else face the consequences. Last month Iowa approved House File 589, a legislation advertised as outlawing “agricultural production facility fraud.” Once Governor Terry E. Branstad signed the act into law in early March, police and prosecutors in Iowa were allowed the power to bring criminal charges against anyone who enters farming facilities by means of deception. The act was touted as a way of keeping agriculturists within the state from having outsiders infiltrate harm to their businesses, however, opponents of the law say that farmers were upset over how video footage and other information captured from their facilities were introducing information to the public that would cut profits by way of revealing the real conditions that livestock are subjected to. Mercy for Animals, an advocacy group, is opposed to House File 589 on grounds that it makes anyone who "expose cruelty to animals, corporate corruption, dangerous working conditions, environmental violation, or food safety concerns at factory farms” a criminal in the eyes of the state. The American Veterinary Medical Association explains in their own report that in the last three years, Mercy for Animals has released footage that shows abuse within Iowa farming facilities, which means that the state can now prosecute journalists that obtain that footage by surreptitious means with the alleged intent of harming business.

JEFFERSON CITY, Missouri -- The Missouri House endorsed legislation Tuesday that would make it a crime for undercover activists to produce videos portraying poor conditions at livestock farms or other agricultural facilities. The legislation given first-round approval would create the crime of “agriculture production facility interference.” It would apply to anyone who makes or distributes photos, videos or audio recordings of the activities at an agricultural facility without the consent of the owner. The bill also would make it a crime for people to gain employment or access at agricultural facilities under false pretenses. Supporters of the legislation pointed to Iowa, which last month became the first state to make it a crime for people to lie in order to gain access to a livestock operation to record alleged animal abuse. The Iowa law came after the Los Angeles-based group Mercy for Animals had released undercover videos depicting conditions for chickens and hogs in Iowa. “Unfortunately, we live in a society where these activists are becoming more and more of a problem to agriculture,” said state Rep. Casey Guernsey, R-Bethany, the sponsor of the Missouri legislation. “We cannot afford to allow these groups to target our industry of agriculture in Missouri like they have in Iowa.” The House endorsed the legislation by a 124-29 vote, with some Democrats joining majority party Republicans. A second House vote is needed to advance the bill to the Senate, where legislation can more easily be blocked by a few determined opponents. In the House, some urban Democrats suggested that the Missouri legislation was an overreaction by agricultural groups. They said some undercover videos have helped put an end to deplorable conditions.
